CSA Discipline Committee reaches decision re: Aab,Bowie,Hodges and Troke

The CSA Discipline Committee has come back with its decision of its hearing for Shauna Aab, Danny Bowie, Les Hodges and Mike Troke.

67.The misconduct complained of is the involvement of the Responents in the affairs of the ASA in such a way as to bring soccer into disrepute. The penalty for such misconduct ought to, in our opinion, restrain the Respondents from engaging in any such further behaviour so long as that in doing so the penalty also serves as a deterrent to others who may otherwise consider engaging in similiar behaviours. The penalty ought not to cause other innocent parties (clubs, teams or players) to suffer loss.

68. Accordingly having found that the Repondents did commit misconduct contrary to the Policy the Panel feels that an appropriate penalty is to suspend the Respondents from any involvement in the governance of soccer at the National or Provincial Level for a period ending on June 30, 2012. The Respondents are hereby enjoined from serving as directors or officers of the Alberta Soccer Association or the Canadian Soccer Association and further restricted from holding any position holding a governance function in either organization for a period ending on June 30, 2012.

69. In the interest of clarity it is to be noted that it is not the intention of the Panel to in any way restrict the Respondents from participating in soccer at a local or regional level and they are free to, for example, serve on the executive of a local club or association; coach a soccer team or perform any other function so long as that in doing so they do not assume any governance role with respect to soccer either provincially (Alberta only) or nationally.

70. Given the concern raised by the Respondents as to their being singled out for prosecution by the CSA the suspension of the Respondents particularized in paragraph 68, above, shall not commence until the 5th day after receipt by them, through their counsel, of a letter from the CSA confirming that a Notice of Hearing has been sent to each of the other persons or organizations who commenced litigation involving the Alberta Soccer Association in the Courts of Alberta in calendar year 2010.

74. The point here is that these Respondents feel singled out and can easily point to other Court proceedings that appear to not have resulted in disciplinary action being taken by the proponents of that litigation by the CSA. Accordingly this Panel feels it is appropriate to stay the commencement of the suspension of these Respondents until such time as they are notified that the other Plaintiffs/Petitioners (as distinct from Defendants or Respondents) involved in litigation regarding the Alberta Soccer Association are sent a Notice of Hearing.
